Terms and Conditions

These Terms and Conditions (“Terms”) govern the use of the website and services provided by Los Angeles Yacht Charter LLC (“Company,” “we,” “us,” or “our”). By accessing our website, making a booking, or chartering a vessel, you agree to be legally bound by these Terms. If you do not agree, do not use our services.

1. Definitions

  • “Charter” means the rental of a yacht and related services provided by the Company.
  • “Client,” “you,” or “your” means the individual or entity making the booking.
  • “Vessel” means any yacht or watercraft chartered through the Company.
  • “Charter Period” means the agreed time and date of the charter.

2. Eligibility

You must be at least 18 years of age and legally capable of entering into binding contracts to book a charter. By booking, you confirm that all information provided is accurate and complete.

3. Booking & Charter Services

All bookings are subject to availability and confirmation by the Company. A booking is considered confirmed only once payment has been received and written confirmation has been issued by the Company.

The Company reserves the right to refuse service to anyone for any lawful reason, including safety concerns or violation of these Terms.

4. Pricing, Payments & Authorization

All prices are listed in U.S. Dollars unless otherwise stated. Full payment is required prior to the charter unless explicitly agreed otherwise in writing.

By providing payment information, you authorize the Company to charge your payment method for all amounts due, including charter fees, additional services, fuel surcharges, damages, excessive cleaning, overtime, or other costs incurred.

You acknowledge that charges may appear on your credit card or bank statement under the Company’s business name or payment processor descriptor.

Additional costs may apply, including but not limited to fuel, crew gratuities, catering, docking fees, and special requests. You are responsible for all charges incurred during or as a result of the charter.

5. No Cancellation, No Refund & Earned Fees Policy

ALL SALES ARE FINAL.

You acknowledge and agree that yacht charters are time-sensitive, capacity-limited services. Once a booking is confirmed, the reserved charter time is removed from availability and cannot be resold.

Accordingly, all payments are earned upon booking and are irrevocable, non-refundable, and non-transferable, with no cancellations, refunds, credits, or rescheduling under any circumstances, including but not limited to:

  • Weather conditions
  • Illness or personal emergencies
  • Travel delays, missed departures, or no-shows
  • Client dissatisfaction or change of plans
  • Mechanical issues not attributable to gross negligence

Failure to appear for a scheduled charter, late arrival, or voluntary early departure does not constitute non-performance by the Company. Services are deemed fully rendered at the scheduled start time of the charter.

By booking a charter, you expressly acknowledge and agree to this strict no-cancellation, no-refund, earned-fee policy, which is prominently disclosed and accepted at the time of booking.

6. Weather, Captain Discretion & Force Majeure

Charters operate rain or shine unless the Company or vessel captain determines, in their sole and absolute discretion, that conditions are unsafe or impractical for operation.

The Company reserves the right to delay, modify, substitute vessels, alter routes, or terminate a charter due to weather, sea conditions, mechanical issues, acts of God, governmental actions, or other events beyond reasonable control.

Client disagreement with weather conditions or safety determinations does not entitle the Client to a refund, credit, or charge reversal. In such cases, the Company may, but is not obligated to, offer rescheduling at its discretion.

7. Burials at Sea – No Responsibility or Ownership

Los Angeles Yacht Charter LLC does not organize, conduct, supervise, authorize, or perform burials at sea and does not provide funeral, memorial, or disposition-of-remains services of any kind.

Any burial at sea or scattering of remains that occurs in connection with a charter is arranged solely by the Client and/or independent third parties, and is subject to all applicable federal, state, and local laws, including U.S. Coast Guard and Environmental Protection Agency regulations.

Los Angeles Yacht Charter LLC does not take custody, ownership, possession, or control of human remains or cremated remains at any time, and assumes no responsibility or liability whatsoever for the handling, transport, storage, release, or disposition of remains.

The Client bears full and exclusive responsibility for legal compliance, permits, documentation, ceremonial activities, and the conduct of all participants. The Company expressly disclaims all liability for any claims, damages, losses, regulatory violations, emotional distress, or disputes arising out of or related to any burial-at-sea activity, whether alleged to arise from negligence or otherwise.

By booking a charter, you acknowledge that Los Angeles Yacht Charter LLC’s role, if any, is limited solely to facilitating vessel access through third-party operators and that all burial-at-sea activities are undertaken entirely at the Client’s own risk.

7. Safety & Conduct

All passengers must comply with crew instructions and applicable maritime laws at all times. The Company reserves the right to terminate a charter immediately without refund if unsafe, illegal, or disruptive behavior occurs.

Prohibited conduct includes but is not limited to:

  • Illegal drug use
  • Excessive intoxication
  • Harassment or violence
  • Damage to the vessel or equipment

8. Liability Disclaimer

Chartering a yacht involves inherent risks. To the fullest extent permitted by law, the Company shall not be liable for any injury, loss, damage, delay, or expense arising from the charter, except where caused by gross negligence or willful misconduct.

You voluntarily assume all risks associated with maritime activities, including boarding, disembarking, swimming, and recreational activities.

9. Indemnification & Chargeback Liability

You agree to indemnify, defend, and hold harmless the Company, its owners, employees, crew, and agents from any claims, damages, losses, liabilities, costs, or expenses arising out of your charter, your conduct, or violation of these Terms.

Chargebacks & Payment Disputes: By completing a booking, you expressly agree not to initiate any chargeback, payment dispute, or payment reversal with your credit card provider or financial institution for any reason.

Any chargeback initiated in violation of these Terms shall constitute a material breach of contract, and you agree to be liable for all costs incurred by the Company in responding to such dispute, including administrative fees, chargeback fees, legal fees, and collection costs.

10. Insurance

The Vessel is insured in accordance with applicable maritime regulations. This insurance does not cover personal belongings, personal injury beyond statutory limits, or damages caused by client negligence or misconduct.

Clients are encouraged to obtain their own travel or event insurance.

11. Third-Party Charter Providers & Agency Disclaimer

Los Angeles Yacht Charter LLC may act as a booking agent, referral service, or facilitator for yacht charters operated by independent third-party vessel owners, operators, or charter companies, including but not limited to vessels operating in or around Los Angeles, California.

Unless explicitly stated otherwise in writing, the Company does not own, operate, manage, or control the vessels listed or booked through the website. All vessels are owned and operated by independent third parties who are solely responsible for vessel operation, crew, maintenance, safety, seaworthiness, insurance, and compliance with applicable maritime laws.

The Company is not a common carrier and does not assume responsibility or liability for the acts, omissions, negligence, or misconduct of any third-party vessel owner, operator, captain, crew, or service provider.

By booking a charter, you acknowledge and agree that your contractual relationship for the operation of the vessel is directly with the third-party vessel owner or operator, and that the Company’s role is limited to facilitating the booking and related administrative services.

12. Intellectual Property

All website content, logos, text, images, and branding are the property of the Company and may not be copied, reproduced, or used without prior written consent.

Use of our website and services is subject to our Privacy Policy. By using our services, you consent to the collection and use of information as described therein.

13. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to conflict of law principles.

You agree that any dispute arising out of or related to these Terms or the charter services shall be brought exclusively in the state or federal courts located in Los Angeles County, California, and you consent to such jurisdiction.

14. Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

15. Electronic Agreement, Records & Modifications

Your electronic acceptance of these Terms constitutes a legally binding agreement equivalent to a handwritten signature.

The Company may retain electronic records, including but not limited to IP addresses, timestamps, transaction data, booking confirmations, and communications, as evidence of authorization and agreement.

The Company reserves the right to modify these Terms at any time without prior notice. Continued use of the website or services constitutes acceptance of the revised Terms.
